DRAMSHOP CLAIMS

When an intoxicated person gets behind the wheel and causes a crash, the results can be catastrophic. The Texas Dram Shop Act, Section 2 of the Texas Alcoholic Beverage Code, allows those injured by a drunk driver or the family of those killed to bring a lawsuit against the bar, restaurant, or other business provider who may be responsible for serving the drunk driver.

WHAT MUST A PLAINTIFF PROVE?

Typically, a plaintiff must prove that at the time the business provided alcohol to the drunk driver, that the individual was obviously intoxicated such that he or she was a danger to themselves or others. Additionally, the plaintiff must prove that the over serving of alcohol led to the injuries and damages complained of by the plaintiff.
